Domestic Violence

Domestic Violence occurs when a person has been subjected to physical, verbal or sexual abuse by a spouse or former spouse, a present or former household member, any person with whom the victim has a child in common or whom the victim anticipates having a child in common, if one of the parties or with whom the person has or had a dating relationship. To qualify for relief under the New Jersey Prevention of Domestic Violence Act, N.J.S.A. 2C:25-1, et. seq., the abuser must have committed one of the following acts: homicide, assault, terroristic threats, kidnapping, criminal restraint, false imprisonment, sexual assault, criminal sexual contact, lewdness, criminal mischief, burglary, criminal trespass, harassment or stalking. If you are a victim of domestic violence, you can obtain a domestic violence restraining order. The offender may also be charged criminally.

Domestic Violence cases are complex because the case can involve civil, criminal and matrimonial proceedings.
